The 5th nightingale did not lay an egg in the nest

I was expecting that the 5th nightingale would lay an egg in the nest. I had no ideea that the the nightingale comming from the birdbath wouldn't count. But then, why the birdbath can hatch the chick from an egg you have in the nest? Is this a bug?

It's multiples of 10 to get the bird to sit in the nest.  And they absolutely do count from the birdbath.

You'll then be given a task by the bird to spot in other gardens, and that's multiples of 5.

No, every 5th bird can help to build a nest but only every 10th bird spotted in your garden can nest.
The birds from the birdbath count too.

It states 10 birds in the guide under "Chicks" category:

"Decide which chick you'd like to try for first, and attract the adult bird to your Garden while the completed nest is sitting there empty. Every 10th of that bird spotted in your Garden will nest in your empty nest (remember, the nest must have been part-built by that same type of bird!)"
